CONCERNING
THE SECOND AMENDMENT TO THE REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE No. P-41/BC/2008 CONCERNING EXPORT CUSTOMS NOTIFICATION

THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE,

Considering:

a. that in the framework to support the policy of Bank Indonesia, which requires exporters to deliver the information listed in the Export Customs Notification associated with foreign exchange exported products to the Foreign Exchange Bank, it is necessary to add Foreign Exchange Bank of export products in the Export Customs Notification;

b. that in the framework to improve services and control export through land border and export through Courier Service Company, it is necessary to improve the format and procedures for filling Export Customs Notification;

c. based on the considerations as intended in paragraphs a and b, it is necessary to stipulate Regulation of the Director General of Customs and Excise concerning the Second Amendment to the Regulation of the Director General of Customs and Excise No. P-41/BC/2008 concerning Export Customs Notification;

In view of:

1. Law No. 10/1995 concerning Customs (Statute Book of the Republic of Indonesia No. 75/1995, Supplement to Statute Book of the Republic of Indonesia No. 3612) as amended by Law No. 17/2006 (Statute Book of the Republic of Indonesia No. 93/2006, Supplement to Statute Book of the Republic of Indonesia No. 4661);

2. Law No. 11/1995 concerning Excise (Statute Book of the Republic of Indonesia No. 76/1995, Supplement to Statute Book of the Republic of Indonesia No. 3613) as amended by Law No. 39/2007 (Statute Book of the Republic of Indonesia No. 105/2007, Supplement to Statute Book of the Republic of Indonesia No. 4755);

3. Regulation of the Minister of Finance No. 155/PMK.04/2008 concerning Customs Notification;

4. Regulation of the Minister of Finance No. 184/PMK.01/2010 concerning Organization and Work Flow of the Ministry of Finance;

5. Regulation of the Director General of Customs and Excise No. P-41/BC/2008 concerning Export Customs Notification as amended by Regulation oft eh Director General of Customs and Excise No. P-07/BC/20009;

DECIDES:

To stipulate:

REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING THE SECOND AMENDMENT TO THE REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE No. P-41/BC/2008 CONCERNING EXPORT CUSTOMS NOTIFICATION.

Article I

Several provisions in Regulation of the Director General of Customs and Excise No. P-41/BC/2008 concerning Export Customs Notification as amended by Regulation of the Director General of Customs and Excise No. P-07/BC/2009 are amended as follows:

1. The provision of Article 3 paragraph (3) is amended so that Article 3 is read as follows:

"Article 3

(1) Export Notification as intended in Article 2 paragraph a, may be submitted in writing on a form or in the form of electronic data.

(2) Export Notification form as intended in paragraph (1) determined by using the BC 3.0 code.

(3) Notification Form as intended in paragraph (2) made with the following provision:

a. by using A4 size paper (8.3 x 11.7 inches), Letter (8.5 x 11.0 inches), Legal (8.5 x 14.0 inch) or Folio (8.5 x 13.0 inch).

b. consists of:

1. The first sheet;

2. continuation sheet of customs complementary documents, in case of the first sheet can not accommodate all the customs complementary documents data;

3. continuation sheet of Export Result Foreign Exchange Bank, in case of export transactions through more than 1 (one) Foreign Exchange Bank;

4. continuation sheet of container, in case of the number of containers that are notified more than 1 (one) containers;

5. continuation sheet of exported goods data, in case of Export Notification more than 1 (one) a description/goods record;

6. continuation sheet of Courier Service Company, in case of export shipment through Courier Service Company for more than 1 (one) senders and 1 (one) receivers, and

7. continuation sheet for export goods that get import facility for export purpose which are combined with other goods, in case of exports of combined goods.

c. in 3 (three) copies to the designation:

1. Customs office;

2. Central Bureau of Statistics (BPS), and

3. Bank Indonesia (BI)."

2. To amend Attachment I of Regulation of the Director General of Customs and Excise No. P-41/BC/2008 concerning Export Customs Notification as amended by Regulation of the Director General of Customs and Excise No. P-07/BC/2009 becomes as determined in Attachment that is an integral part of this Regulation of the Director General.

Article II

This Regulation of the Director General comes into force on June 1, 2012.
